Blackwell, At It Again

A federal judge has ordered the Franklin and Knox County boards of elections to provide paper ballots or other forms of voting to help process the people remaining in long lines.

Lawyers from the Franklin Board and Ohio Secretary of State J. Kenneth Blackwell vehemently objected and vowed an immediate appeal, saying any votes not cast on the regular electronic machines would be illegal.

And it was not immediately clear just what the Franklin County elections board would do to comply with the judge's order.

U.S. District Judge Algenon L. Marbley held an emergency hearing at the request of the Ohio Democratic Party and issued his order just as the polls were closing.

Ohio law requires that everyone in line when the polls close be allowed to vote, no matter how long it takes. A poll worker stands at the end of the line if necessary to mark where voting will end.

But Democrats argued with lines snaking out the door of many polling places and waits of several hours, voters are getting discouraged and leaving before casting their votes.

"Participation in this Democracy should not be as onerous as it is being made today," Marbley said before issuing his order.

Why does Ken Blackwell hate counting your vote?  Let me guess, this was one of the blue neighborhoods.

Beacon Journal: Michael Moore causes stir in Cuyahoga County
Moore said his crews had found no evidence of wrongdoing in Ohio. ``What I've seen here so far isn't official abuse, it's neglect,'' he said, referring to the insufficient number of voting booths in many precincts. The footage, he said, would be made available to reporters and turned over to federal authorities. ``I'm not making a movie,'' he said. ``I'm here as a citizen to stand up for the right to vote.''
Blackwell simply has failed in his most important assignment, protecting your vote (and not just handing an election to Bush).

On The Brighter Side

In another legal battle Blackwell lost today Judge rules for news organizations over poll access in Ohio

Huzzah! for the First Amendment. (You know, they make it first for a reason, didn't you?)

Scattered reports of problems in Lucas County, Ohio (Toledo):
  • Voting machines locked in a closet at one station, voting started late causing some voters to leave.
  • Three machines at one station (optical scanners), one never worked and the other two jammed. No voting until a technician came out to fix it. (why isn't someone trained at each polling center to at least clear a friggin' paper jam? Geez.)
  • Long lines . . . real long lines, and early "commotion," over the confusion about challengers.

Embarassing

When you have the fourth and fifth most "googleable" site for the term: "vote where you are supposed to vote", how the hell does my son end up with a provisional ballot, which probably won't be counted?

It is obvious he spent too much time in Florida as a child.

UPDATE: I stand Corrected. Fred, sorry I ever doubted you! Let's just say I was given some erroneous data. You did me proud and went the extra mile (literally) to vote where you were supposed to vote.

A Mess in the Making

Ohio Voter Suppression News has the link to the rationale of allowing GOP thugs into every black precinct in the state here.

This post will update as I try to document any challenge shenanigans I come across.

Going Well So Far

So far, a lot of the Republican challengers simply haven't shown up...it's Democrats sitting there, reading over their paperwork, listening to conversations, playing paper football with themselves.



Some "commotion" reported at my polling place. No Democratic challenger assigned but 5 were ready from the GOP (one for each precinct). Thanks to the Ohio Supreme Court they only were left with one who said he hadn't made any challenges and was just there to "observe the process."

I asked him what he was doing different than the assigned democrat and republican witness the board of elections. He squirmed a bit and said, "I'm just the eyes of the Republican Party." Phooey!

Our absent Governor, Taft, finally had something to say on American Morning today. Thank god for term limits. What a stooge. A more partisan walking, talking, point(less) goof I couldn't find in a bag of tacks.
Hmm, I really shouldn't flatter myself that I was another victim of a Denial of Service Attack. But why was my site so sportatic and updatable, and just plain down for 10 hours this morning?

DOS Attack on Conservative Blogs? It wasn't just the Conservative blogs.
6:01am is reporting that several "conservative" blogs (perhaps properly warbloggers) are/were down or have suffered denial of service attacks. Great idea! Because everyone knows how quiet and reserved bloggers are. . . Is Instamartyr.com taken?

Who is really surprised that the very same court that annointed Shrub would allow the potential for race baiting and chaos at the Ohio Polls and allow the challengers in but keep international observers and the press out?

And who is surprised that I got hacked last night and was locked out of my site?

Court OKs Voter Challengers at Ohio Polls: South Florida Sun-Sentinel
CINCINNATI -- Giving a pre-dawn Election Day boost to the GOP, a federal appeals court early Tuesday cleared the way for political parties to send in people to challenge voters' eligibility at Ohio polling places. The U.S. Supreme Court declined to step in.

Overturning the orders of two federal judges, a three-judge panel of the 6th U.S. Circuit Court of Appeals ruled 2-1 early Tuesday that the presence of Election Day challengers was allowed under state law. It granted emergency stays that will allow Republicans and Democrats one challenger per precinct each.
No amount of lawyers can ovbercome a rigged concervative bench with the few liberals left cowed and intimidated by the screed of "liberal" becoming a dirty word.

You can thank "Crackhead" Chad Staton, for much of the GOP's talking points, asshole.

Before I was locked out of my site for 8 hours, I was attempting to chronicle the Challenge cases. And while smiling GOP operatives are saying "this will be great" as they fan out to screw with minority voters, much of why they can be there at all, and what it really means, can be found , here, and here.

I so want my country back. I so want to stop hearing every radio voice out there blaming the very media they propagandize through for the nation not walking in lock-step behind their intollerant ideology. I so want the MSM so cowed by fear of being labled as liberally biased they cow-tow to the disingenuiousness of fair and balance moral equivilence. I so want the courts back in sensible hands and not the plaything of partisans.

I so want John Kerry to be President.

Folks, if you see anything out of the ordinary whatsoever at your polling statioin, document it, take names, report it and follow up. Don't let this age old Jim Crow stuff go.

But keep the line moving.

Challenger Challenges Challenged

Confused? You should be.  Keep your cool.  This is what they want.

Ohio GOP operatives have lost three separate cases today in an effort to place intimidators challengers in every Ohio polling place with a substantial minority population.  The latest came all the way from New Jersey. The Secretary of State and the Attorney General, both Republicans, were content to let the ruling stand through election day.   Our Republican Governor is AWOL. That hasn't stopped the party itself from appealing anyway, leaving open the possibility for chaos in urban polling centers throughout the state.

U.S. District Judge Dickinson Debevoise in Newark, New Jersey, ruled that Republicans violated decrees he issued in the 1980s that barred political parties from using race or ethnicity as a factor in challenging the integrity of voter registrations.

The ruling came after two U.S. judges in Ohio ruled in separate cases today that only poll workers, not challengers working for Republicans, could determine if the 23,000 people could vote. Debevoise said Ohio Republicans joined the Republican National Committee in unfairly targeting minority voters in trying to stamp out fraud.

``The effect of such activities is to deter qualified voters from voting,'' Debevoise said in issuing his ruling. ``The public interest is always served by encouraging people to vote.''

Debevoise ordered the Republican National Committee to tell its poll challengers to forgo use of the list tomorrow. Attorneys for the national party immediately appealed to the U.S. 3rd Circuit Court of Appeals in Philadelphia, which oversees Debevoise.

The Republicans will stop at nothing to stop you from voting.  While Karl Rove raves and rants about "Crackhead Chad," and promises wins in Florida and Ohio (not PA, which allowing for the hype factor on the other parts of "FLOHPA" is telling me there's a sweep in the making), his minions are still up to no good and true to form the ones making the biggest mess are faceless.

The Ohio cases are also being appealed as well, but not by our state officials.

Poll Challengers' Status Up In The Air, Court Must Decide Whether To Overturn Federal Judge's Ban The challenge to the challengers is spilling over into Election Day, reports News 5's John London. There's no guarantee the 6th U.S. Circuit Court of Appeals in Cincinnati will rule by Tuesday morning, so even if Ohio polls open without challengers, a court ruling could let them in at any time during the day.

Noticeably absent from all the pre-election controversy here in Ohio is the voice of our illustrious (cough) Governor Taft.  Just who is running the Ohio GOP anyway?  Sec. St. Blackwell decided to back off this fight, Attorney General Petro decided to go forward, and lost at trial. 

Blackwell probably figured he had done his bit for the party in throwing out registrations for being on the wrong card stock and pushing through an incredibly restrictive provisional ballot ruling.  Not even he could fight the clearly fictitious petitions Ralph Nader tried to submit, and he's sees the potential for great chaos at every polling station if the GOP partisans get their way and can indiscriminately pull anyone out of line because they don't look right.  But whither Taft?

Against Blackwell's orders, Petro elected to appeal, but wasn't planning on doing anything until after the election.  GOP Attorney Mark Weaver found three empty suits and filed an appeal of two federal judges' rulings (one a Bush appointee, the other a Clinton judge), thus forcing Petro into a rush to prepare briefs which were requested by the 6th Circuit Court of Appeals.  Governor Taft was not one of those empty suits.  (See companion story in the Beacon Journal)

It's supposed to be nasty cold and wet in much of Ohio tomorrow.  Add in a few feckless challenges to legitimate voter' right to cast their ballot and lines could stretch and slow to a crawl.  The potential for some white guy in a suit getting popped in the mouth for arbitrarily singling out a black dude who works for a living (and works hard and doesn't have time to take off from work all day to put up with this obvious crap), and the GOP has just what it's been wanting all along.  Cops called out for a "racial incident," people go home instead of waiting in line and the Republithugs get to show how unreasonable and radical our side is.

The racial undertones are transparent. 

As part of her ruling, [Judge] Dlott said that in Hamilton County, only 14 percent of newly registered voters in majority white districts would have seen challengers at the polls Tuesday. However, 97 percent of newly registered voters in majority black districts would have seen challengers.

They're race baiting.  They know they're wrong but they don't care.  As Jesse said, they are at war with liberalism and minorities and will get to fighting terrorism when it no longer serves their purposes -- which is keeping you afraid.

GOP to Appeal Voter Challenge Ruling

AP Wire | 11/01/2004 | Two federal judges deny voter challengers at polls

CINCINNATI - Two federal judges on Monday barred political parties' challengers from polling places throughout Ohio. State Republicans planned to appeal.

An order by U.S. District Judge Susan Dlott of Cincinnati found that the application of Ohio's statute allowing challengers at polling places was unconstitutional.

U.S. District Judge John Adams of Akron said poll workers are the ones to determine if voters are eligible.

"In light of these extraordinary circumstances, and the contentious nature of the imminent election, the court cannot and must not turn a blind eye to the substantial likelihood that significant harm will result not only to voters, but also to the voting process itself, if appointed challengers are permitted at the polls," Adams said.
Wingnut Alert, don't forget to get your "Democrats want to win this in the courts" talking points in order. Secretary of State Blackwell wanted to withdraw these cases, but Republithug Atty General Jim Petro and mercenary GOP attorney Mark Weaver are appealing to the 6th Circuit.

In comments made before Adams ruled, Mark Weaver, lawyer for the Ohio Republican Party, called Dlott's ruling erroneous and said the party would ask the 6th U.S. Circuit Court of Appeals in Cincinnati to overturn it.

I'll update when I learn more. Note that Blackwell and Petro are positioning themselves for a run at Governor in '06 (Against Jerry Springer for the Dems -- sweet)

ADDENDUM: Ashcroft Weighs In Akron Beacon Journal - Challenge to voters legal

The U.S. Department of Justice has decided that the Ohio law that allows people to challenge voters at the polling places Tuesday does not violate a voter's civil rights and is therefore constitutional.

Assistant U.S. Attorney R. Alexander Acosta filed a document in the Cincinnati court of U.S. District Court Judge Susan Dlott -- a Clinton appointee -- that says the Justice Department believes the challenger law in Ohio is constitutional.

It is the first time a federal official has picked sides in the dispute over the voter challenger law.
